Commerce Commission to investigate TelstraClear application for resale of virtual private network services
The Commerce Commission has announced it will investigate an application from TelstraClear for a determination of the terms for the wholesaling of business services offered by Telecom New Zealand Limited. In particular, TelstraClear has applied for access to three private data networking services, one business smartphone service, one directory service, and a temporary disconnection service.
Submissions from the parties on the applications are due by 17 December 2004.

Background On 4 November 2004, under the Telecommunications Act 2001, TelstraClear filed an application for an access determination concerning the supply to TelstraClear of a number of retail services offered by means of Telecom's fixed telecommunications network.
Section 25 of the Telecommunications Act 2001 requires that the Commission: decide whether or not to investigate the matter; give written notice of its decision to the parties; give public notice of its decision; request the parties to the determination to make submissions on the matter by written notice to the Commission not later than 10 working days after receipt of notice from the Commission of a decision to investigate.
