Commission receives clearance application from VisyPET
The Commerce Commission has received an application from VisyPET (NZ) Limited trading as VisyPak, seeking clearance to acquire some or all of the two-stage PET manufacturing assets and related business contracts of Visy Industrial Plastics (NZ) Limited (VIP).
The application relates to a recent Commission decision granting clearance to VIP to acquire certain assets from ACI Operations NZ Limited.
The Commission granted the clearance on the basis that the Commission considered that VIP and VisyPak were associated, and that the on-sale of the ACI assets by VIP to Visypak formed part of the proposal.
In considering this new application, the Commission’s role is to determine whether the proposed acquisition has the effect of substantially lessening competition in a market.
