Penal And Criminal Procedurec Code Review

The Law Reform Commission will review this year the Penal Code and the Criminal Code.

Minister of Justice and Legal Affairs Mr Toswell Kaua revealed this in his speech on the debate of the 2008 budget yesterday.

"This review should enable them to review and look into the current loopholes in the current Penal Code including the penalty provisions for many of the criminal offences contained in the Penal Code," he said.

The Minister said the review would be an ideal opportunity to look into traditional humane practices as alternative penalty provisions for some of the most suitable offences.

Mr Kaua said the Law Reform Commission Officers would be touring the provinces to receive submissions from provincial stakeholders on this review and other review they are working on.

"The review of the Penal Code will also give us the opportunity to look into sentences that are alternatives to imprisonment considered relevant to Solomon Islands", he said.

The Law Reform Commission according to the Minister is planning to outsource one of its references, which is to do with the Acts of the UK of general application and in force on 1st January 1961.

"This exercise is important to Solomon Islands as we need to know which of the UK laws of general application apply in Solomon Islands since 1st January 1961. At present this information is not readily available to people of Solomon Islands", he said.
