REF: 2006 BLUE LANTERN GUIDEBOOK

1. This is an Action Request. See paragraphs 2-4.

2. The Department's Office of Defense Trade Controls
Compliance (PM/DTCC) requests Post's assistance in conducting
a post-shipment check on license 05989685 for the export of
one (1) International Traffic in Arms (ITAR)-controlled C-130
Hercules aircraft to the Central African Republic (CAR).
Post is requested to complete this Blue Lantern inquiry
within 45 days. Lack of response to a Blue Lantern inquiry
will affect pending and future licenses involving parties to
this license.

3. Reason for request: The Department possesses evidence that
the Government of the CAR has temporarily transferred its
C-130 to Ogma, a company in Portugal, for repair and
refurbishment purposes without obtaining prior approval from
the Directorate of Defense Trade Controls (DDTC) as required
per Part 123.9(c) of the ITAR.

4. ACTION: The Department requests that Post contact CAR
government officials in order to obtain the details
surrounding the re-export of the C-130 from CAR to Portugal.
Post is also requested to remind CAR government officials of
the restrictions on USML items, especially the prohibition
against unauthorized re-transfer and re-export.

The following points are included for guidance:

--Would the Government of the CAR please confirm if it
exported its C-130 to Ogma in Portugal?

--Did the Government of the CAR submit a re-export
authorization request to the Department of State, Directorate
Defense Trade Controls?

--What was the purpose of the export?

--When did the export occur?

--How did the export occur? Who was responsible for piloting
the aircraft to Portugal?

--When will the aircraft be returned to the CAR? Who will
pilot the return flight?

--Would the Government of the CAR please confirm if any other
entities have received C-130 parts for repair or
refurbishment?

--Does the Government of the CAR understand the restrictions
on USML items, especially the prohibition against
unauthorized re-transfer and re-export? Is the Government of
CAR aware that this rule applies to temporary re-exports, in
addition to permanent exports?

6. Submitted in support of the license application were the

Unclassified Defense Articles and Related Unclassified
Technical Data, signed 25 January 2006, approved 3 February
2006.
