“The ‘bottom pinching’ or bottom grabbing is a sexual assault. The criminal offence is called "indecent assault". She is a female prison officer, and did not want, or ask to be sexually assaulted by a prisoner. She has a right not to be violated, anywhere, particularly in her work place (a prison).” McVicar
The founder of the Sensible Sentencing Trust says the Minister of Justice, Andrew Little is so desperate to get rid of Three Strikes he is prepared to tell lies and mislead the public.
“Not once was this mentioned leading up to the Election and now they are misleading the public again by telling half-truths and spreading lies”.
“The Minister is using Raven Campbell as his pin-up boy to
discredit Three Strikes but he hasn’t told the
truth.”
“Campbell is a notorious recidivist offender
who had been given the full leniency of the Court for his
prior offending but was a habitual offender who thought he
was bigger than the law.”
“Campbell’s sentencing notes make it very clear that he needed to be taught a lesson and the public needed to be protected from him – that is precisely what 3S was designed to do.”
“The Minister also neglected to tell the public that Campbell’s 7 year sentence was subject to parole, meaning that if this guy could convince the Parole Board he was rehabilitated he could be released at 1/3 of his sentence.”
McVicar said, this offender has a serious prior criminal record. In addition to numerous other convictions, his first and second strike offending was:
1st strike: Bank robbery - max possible sentence 10 years imprisonment. The Judge didn't even imprison him for that. He got a slap on the hand, and was sentenced to "community detention" which is even lighter than "home detention".
2nd strike: Aggravated robbery - max possible sentence 14 years imprisonment. He and an associate attacked a completely innocent man and repeatedly bashed him to the head with a hammer. Victim seriously harmed. For that he was imprisoned for 3 years, 4 months.
3rd strike: While serving that sentence, he indecently assaulted the female prison guard. That was his 3rd strike. He was sentenced to a maximum term of 7 years imprisonment, with eligibility to apply for parole after 2 years, 4 months. So he may not serve the 7 years at all. It's up to him. If he can prove to the parole Board he has "rehabilitated" they will let him out on parole early.

She is a female prison officer, and did not want, or ask to be sexually assaulted by a prisoner. She has a right not to be violated, anywhere, particularly in her work place (a prison).”
McVicar said the Minister is also misleading the public by saying there is no evidence 3S is working when the evidence in fact is exactly the opposite.
“Ministry of Justice figures show that in the 5 years following Three Strikes, 35% fewer offenders were convicted of a second strike than in the 5 years period prior to Three Strikes.” ENDS
