RE: STEPHEN DUDLEY CASE: REQUEST TO APPEAL DISCHARGE WITHOUT CONVICTION ENTERED IN THE HIGH COURT AT AUCKLAND ON 7 AUGUST 2014 IN R VM [2014] NZHC 1848
On 8 August 2014 Crown Law received a request from the office of the Auckland Crown Solicitor to consider a Crown appeal against the discharge without conviction entered in respect of M in the High Court at Auckland on 7 August 2014, by Her Honour Justice Winkelmann. This statement is made in light of the significant degree of public and media comment generated as a result of the decision.
The Deputy Solicitor-General has carefully considered the facts and the relevant legislative provisions and has determined that in this particular case there is no jurisdiction to appeal or review the Judge’s decision.
