Court decision vindicates Commission approach
Today’s decision by the High Court to reject Chorus’ appeal against the Commerce Commission’s IPP pricing model for
Unbundled Bitstream Access is a victory for common sense says InternetNZ (Internet New Zealand Inc).
InternetNZ Chief Executive Jordan Carter said the great news out of the decision is the clarity that it will provide
when it comes to setting New Zealand’s copper broadband prices.
“There’s been some hazy language around section 18 of the Act but today’s decision shows the Commerce Commission has
been using the Act in exactly the right way.
“Clearly the Commerce Commission knows what it’s doing and it should be left to get on and do its job.”
Mr Carter has called on Chorus to drop further legal action on this point, as more action would simply prevent the
industry from reaching certainty.
"The regulatory focus in the industry now needs to be on the FPP process, which will finally set the copper broadband
prices," Jordan Carter says.
