EDS to file further proceedings regarding King Salmon
The Environmental Defence Society has announced that it will be filing proceedings in the Supreme Court seeking to
overturn a recent High Court decision regarding King Salmon’s proposals for two salmon farms in the outer Marlborough
Sounds.
“The special fast-track procedure means that we have to seek leave from the Supreme Court to appeal the High Court
decision,” said EDS Chairman Gary Taylor.
“The Supreme Court can grant leave and hear the appeal, can refer the matter to the Court of Appeal to be heard or can
refuse leave.
“We have argued in our application that the High Court made errors of law regarding two sites: Port Gore and Waitata.
EDS does not oppose two other salmon farms at Richmond and Ngamahau.
“Our concerns relate to the way the High Court (and the earlier Board of Inquiry) applied the provisions of the New
Zealand Coastal Policy Statement 2010 and to the sequence in which the plan changes and the resource consents were
considered.
“These are both matters that could have produced a different outcome in the circumstances of this case and also have a
broader precedent value elsewhere.
“The High Court decision raises important public interest considerations that warrant an appeal.
“The application for leave will be filed in the Supreme Court later today or tomorrow (Thursday) at the latest.
“Acting for EDS will be senior Auckland Barrister David Kirkpatrick and DLA Phillips Fox Partner Rob Enright.
“We expect the case will be considered expeditiously,” Mr Taylor concluded.
