Red Alert

RED ALERT

Christchurch MP Lianne Dalziel is to receive a petition presented by Grey Power Federation President Roy Reid on behalf of every member and so is signed by every Board member. The petition is to seek greater Government financial support for ex-residents of Retirement Villages in the Christchurch red zone.

Many of these ex-residents have been left in serious financial strife, and Grey Power finds this appalling, and so calls for urgent action from the Government.

The Retirement Villages 2006 Code of Practice, in clause 21.5, stated that “If the residential unit is not replaced following an insured event, the resident will receive the full sum paid to the operator, without any capital or other deductions normally made under the occupation right agreement.”

The 2006 Code of Practice was withdrawn due to high Court action by the Village owners’ Association. Despite Judge Frances ruling that “the Act authorises the Code to alter existing contractual arrangements.” the Code was unnecessarily replaced by the 2008 Code. And the wording was “mysteriously” changed to that “as shown in the occupation right agreement” meaning that the amount repaid to the red zone ex-residents was much less, despite the Government buying-out the owners, thus benefiting only the owners.

Now only the Government are able to right this justice.

This is to advise that, because of the anticipated weather, the presentation venue will now be in the Hall of the All Saints Anglican Church, 305 New Brighton Road, Christchurch commencing at 11.00 am on Wednesday 6 June 2012.
