Commission Refers RadioLive, TVNZ OneNews to Police

On 8 February 2012, the Electoral Commission referred the following matters to Police:
• TVNZ OneNews coverage before 7pm on 26 November 2011. It is the Electoral Commission’s view that the broadcast breached section 197(1)(g)(i) of the Electoral Act 1993 because it included statements that were likely to influence any elector as to the party for whom the elector should or should not vote.
• MediaWorks’ broadcast of ‘Prime Minister’s Hour’ on RadioLive 30 September 2011. It is the Electoral Commission’s view that the item was an ‘election programme’ for the purposes of the Broadcasting Act 1989 and was broadcast in breach of section 70 of the Broadcasting Act. Given the interest in this matter, the Commission is making a copy of its decision available here.
As these matters are now with the Police, the Electoral Commission will not be commenting further.
