Further Reform of Habeas Corpus Procedure and Draft Habeas Corpus Amendment Bill
“The Law Commission has been asked by the Government to look at practical difficulties arising with application for the writ of habeas corpus,” Sir Geoffrey Palmer said today.
“We have produced a study paper on these technical legal issues and we are calling for submissions on them by 17 September.
While the writ of habeas corpus is a fundamental bulwark of our constitutional liberties, practical problems have arisen with it in the courts recently and we believe they need to be addressed”.
The study paper accompanied by a draft Bill is on the Law Commission’s website, which is www.lawcom.govt.nz.
