Attorney General's Response to GPJA release
The decision to delegate decisions around criminal prosecutions is not specific to these cases or to the Terrorism
Suppression Act. Successive Attorneys-General have taken the view that it is inappropriate for them as Government
Ministers to become involved in decision-making about prosecution of individuals.
In practice, the authority to give consent to lay charges is delegated to the Solicitor-General.
This is outlined in Crown Law's Prosecution Guidelines.
