After the misfiring of the ACT Party's attempt to delay the Marine and Coastal Area (Takutai Moana) Bill by extending question time, it seems fair that Scoop should share some notes on a previous effort.

During the committee stage of the bill, ACT MP Hilary Calvert proposed an intimidating list of amendments with the claimed intent to "to better reflect the intent of the Bill" (rather than, for example to delay it).

The majority of them were 119 proposed additions to clause 52, which relates to the treatment of stranded marine mammals. Each amendment sought to introduce, as subclause (1A), a specific reference to a different kind of whale, dolphin, seal, manatee or what have you.

It's probably outside the skills of the clerk's office to rule on how sensible some of these amendments were.

Stranded Steller's Sea Cows, for example, are unlikely to cause interracial disputes, as they had been hunted to extinction by 1768.

The Baikal seal, on the other hand, inhabits a freshwater lake in Sibera. If one showed up on the New Zealand coast Scoop hopes it would be more a matter for the Convention on International Trade in Endangered Species. And that nobody would try to force it into the sea.

But the Baikal seal might be a better candidate than every other pinniped on Ms Calvert's list, who may be very lost but are unlikely to be "stranded" if you find them on a beach.

In a combination of both these problems, there is Lipotes vexillifer Baiji - the Yangtze river dolphin. Also a freshwater mammal, a late 2006 expedition found no sign of them; what would be the first recorded extinction of a well-studied cetacean species and the end of probably the cutest dolphin. If any become stranded between our high- and low-tide marks, China will probably want a word.

Scoop has been provided with notes on the amendments, which make an effort to mark extinct, unlikely and misnamed species. They are reproduced below.

Scoop notes that the bill as passed contains, a subclause (1AA), saying that marine mammal here "has the same meaning as in section 2 of the Marine Mammals Protection Act 1978" (which admittedly would include all the non-extinct animals in Ms Calvert's amendments); the passing of this amendment would have rendered all of Ms Calvert's out of order in one go.

Possibly the attempted obstructionism might have been avoided if the Select Committee had actually considered the written submissions.

As it is, Parliament has effectively ignored the committee's only recommendation, that the bill be passed "without amendment", and passed it with a number of amendments.

When Scoop asked committee chair Tau Henare about this, he said "no it doesn't bother me, what bothers me is that the Labour Party Mbrs, the green Party Mbrs didn't read the report." For context and spelling, it worth noting this was on Twitter, and @tauhenare treats more as a bloodsport than a communications portal.
