Supreme Court Decides To Hear Zaoui Human Rights Appeal
The Supreme Court has granted leave to the Crown to appeal the Court of Appeal decision on whether security risk certificate recipient Ahmed Zaoui should have his human rights taken into account by the Inspector General of Security and Intelligence Paul Neazor.
Effectively the decision means that the time until the Zaoui case will be finally decided will be extended for several more months. Earlier the Court of Appeal held, against the submissions of the Crown, that Mr Zaoui's human rights should be taken into account by the Inspector General.
A bench consisting of Chief Justice Sian Elias and Kenneth Keith decided the leave question and delivered their decision at around 3.30pm after hearing argument from the Crown and Zaoui's lawyers.
The appeal was allowed to proceed on two out of three grounds requested by the crown. The court will not hear argument on whether the "high threshold" of security risk is the test to considered by Justice Neazor.
