Supreme Court decision
disappoints DML
Auckland’s community laboratory
provider, Diagnostic Medlab (DML), is extremely disappointed
with today’s Supreme Court decision not to hear DML’s
appeal against an Appeal Court decision that returned a
community laboratory contract to Labtests Auckland
(LTA).
“We have fought hard for more than 2½ years, challenging the DHB’s decision to award the contract to LTA,” says DML’s Chief Executive, Dr Arthur Morris.
“Unfortunately, today’s decision means we have no further legal avenues to pursue.”
Dr Morris paid tribute to DML’s staff.
“The support and loyalty of our staff has been critical to our determination to pursue the matter to today’s disappointing conclusion.” Dr Morris also recorded DML’s appreciation of the support the laboratory had received from Auckland’s primary health community.
Dr Morris said the immediate task would be to meet with the DHBs to map out where to from here.
