Air New Zealand seeks court declaration

In the ongoing dispute between Air New Zealand and the Commerce Commission over cancellation of a settlement agreement, the airline has today filed proceedings in the High Court asking for a declaration confirming that cancellation was valid and effective.

Today’s hearing was adjourned until Friday next week to allow the orderly timetabling and management of the new proceedings.

“In view of the Commission’s stated determination to try to proceed with a penalty hearing regardless of the cancellation of the agreement, it is appropriate that we put our case before the Court for an objective decision,” said General Counsel, John Blair. “Now that this matter is with the Court we are not in a position to comment further.”
