Exide files judicial review proceedings in the High Court
Exide Technologies Limited has filed an application for judicial review with the High Court of New Zealand today.
The application asks the Court to consider whether, by granting consents to export used lead acid batteries in circumstances where they could be disposed of in an environmentally sound and efficient manner in New Zealand, the Minister of Commerce (or the Ministry of Economic Development acting pursuant to the Minister of Commerce's delegated authority) has complied with New Zealand's international and domestic legal obligations as incorporated into NZ law .
Exide has also filed an interlocutory application for interim orders asking the High Court to suspend any decision on four current applications to export approximately 17,800 tonnes of ULABs until a decision on the substantive judicial review application has been made.
Exide's application will be the subject of a teleconference with the judge tomorrow morning to determine when its case and application can be heard.
