The Transfer of Public Holidays
It’s always a bit difficult to work out exactly what happens when a public holiday falls on a Saturday or Sunday, and this year is no different as both Christmas Day and New Year’s Day fall on Sundays. Clayton Kimpton, a Partner at Kensington Swan, advises that there are two possible scenarios as to when employees will observe these public holidays.
If Sunday is normally a working day for an employee, then the public holiday is treated as falling on that day (25 December for Christmas Day and 1 January for New Year’s Day).
If Sunday is not a working day for an employee, then the public holiday must be treated as falling on the following Tuesday (27 December for Christmas Day and 3 January for New Year’s Day).
If an employee works on both Sundays and Tuesdays do not fear! An employee is only entitled to receive one public holiday for Christmas Day and one public holiday for New Year’s Day; in this case the public holidays would be treated as falling on the Sunday.
