Lawyer Sues Councils, Court and Crown in Parking
Dispute Auckland human rights
barrister Dr Frank Deliu has issued High Court proceedings
against various public officials over a 1-year battle over
parking tickets
This afternoon in Auckland renowned legal agitator Dr Frank Deliu brought proceedings against the Auckland and Wellington Councils, the District Court and the Attorney-General claiming that the parking enforcement system is utterly broken and needs High Court intervention.
He claims that the rule of law is suffering as the Councils are out of control, the Courts do not protect the public and the entire system set up by the Crown is contrary to natural justice, including denying the New Zealand public their rights to a fair trial and presumption of innocence.
Dr Deliu invites public watchdog groups to become involved in holding officials accountable. He says "I took a sample of 10 cases in 1 year where I was completely mistreated, and I am a criminal defence lawyer and know the system extremely well. The average person has no chance to be fairly dealt with by the enormous bureaucracy involved. People would rather pay the $15 than fight and so it becomes a system where you cannot really defend yourself. I thought, if so many of these breaches happened to me in such a short period of time, the problem must be endemic. It is time we rise and fight these systemic injustices and this is just another step in making our country a true democracy."
The case is due to be heard in the Auckland High Court on 20 March 2013 at 10:00 am.
