Council settles with Mr Templeton

Following a High Court judgment received on December 7 directing the Kapiti Coast District Council to transfer the land at 55 Waimea Road, Waikanae to Mr Frank Templeton, the Council has reached a full and final settlement with Mr Templeton.

The Council resolved at its meeting yesterday to accept Mr Templeton’s offer for a full and final settlement which includes transfer of the land at 55 Waimea Road to Mr Templeton at no cost. A payment of $48,000 will also be made to cover disbursements paid by Mr Templeton, refund the Legal Aid Committee monies paid on account of the High Court attendances by a Barrister and also to recompense Mr Templeton in a small way for his losses during the extended litigation.

Mr Templeton will install and complete stormwater drainage on the property at his own expense.

Kapiti Coast District Mayor Jenny Rowan said she was pleased that following a meeting with Mr Templeton and his solicitor on December 13, an agreement between the parties had been reached and that today’s decision by the full Council brought to an end a matter which had taken its toll on Mr Templeton and on the Council since June 2003.

Mr Templeton said he appreciated the promptness with which Mayor Jenny Rowan had arranged a meeting to resolve the situation between the Council and himself within a few days of the High Court decision.

“I can now get on with life,” Mr Templeton said.
