Auckland City will not appeal Isola Estate
decision
Auckland City has decided not to appeal to the High Court against a decision of the Environment Court relating to a Waiheke visitor facility.
The Environment Court decision of 2 June 2006 was to overturn council’s decision to decline a notified resource consent application for the proposal.
The application before the Environment
Court was to construct a 52-unit boutique hotel, including
three main accommodation blocks and an
administration/communal facilities building at 74 Onetangi
Road, Waiheke Island.
Appeals to the High Court can be
made on questions of law only, says Councillor Faye Storer,
chairperson of Auckland City’s Planning Fixtures Committee.
“It was a very factual decision. The Environment Court is a specialist tribunal and is entitled to come to its own view on matters of fact.”
