Israeli Settlements Symbolise The Acute Lack Of Justice Experienced By The Palestinian People

GENEVA, 31 JANUARY 2013 – The International Fact-Finding Mission on Israeli Settlements in the Occupied Palestinian Territory today published its findings on the implications Israeli settlements have upon the human rights of the Palestinian people.
The report states that a multitude of the human rights of the Palestinians are violated in various forms and ways due to the existence of the settlements.
These violations are all interrelated, forming part of an overall pattern of breaches that are characterised principally by the denial of the right to self-determination and systemic discrimination against the Palestinian people which occur on a daily basis.
Since 1967, Israeli governments have openly led, directly participated in, and had full control of the planning, construction, development, consolidation and encouragement of settlements, the report states.
“In compliance with Article 49 of the Fourth Geneva Convention Israel must cease all settlement activities without preconditions,” said Ms. Christine Chanet, chair of the Mission from France.
The report states that settlements are established and developed for the exclusive benefit of Israeli Jews. The settlements are maintained and advanced through a system of total segregation between the settlers and the rest of the population living in the Occupied Palestinian Territory. This system of segregation is supported and facilitated by strict military and law enforcement control to the detriment of the rights of the Palestinian population.
“We are today calling on the government of Israel to ensure full accountability for all violations, put an end to the policy of impunity and to ensure justice for all victims,” said Ms. Asma Jahangir, member of the Mission from Pakistan.
The report states that Israel is committing serious breaches of its obligations under the right to self-determination and under humanitarian law. The report also concludes that the Rome Statute establishes the International Criminal Court's jurisdiction over the transfer of populations in the Occupied Palestinian Territory.
“The magnitude of violations relating to Israel’s policies of dispossessions, evictions, demolitions and displacements from land shows the widespread nature of these breaches of human rights. The motivation behind violence and intimidation against the Palestinians and their properties is to drive the local populations away from their lands, allowing the settlements to expand,” said Ms. Unity Dow, member of the Mission from Botswana.
The report states that private entities have also enabled, facilitated and profited from the construction of the settlements – both directly and indirectly.

LES COLONIES DE PEUPLEMENT ISRAÉLIENNES SYMBOLISENT LE MANQUE AIGU DE JUSTICE DU PEUPLE PALESTINIEN
GENÈVE, 31 JANVIER 2013 – La mission internationale indépendante d’établissement des faits pour étudier les effets des colonies de peuplement dans les territoires palestiniens occupés publie aujourd’hui ses conclusions sur l’impact des colonies de peuplement israéliennes sur les droits de l’homme du peuple palestinien.
Le rapport indique qu’un nombre important de droits de l’homme des Palestiniens sont violés de manières et de façons diverses en raison de l’existence de ces colonies de peuplement.
Ces violations sont toutes interdépendantes et faisant partie d’un schéma de violations généralisées qui sont principalement caractérisées par le déni du droit à l’auto-détermination et les discriminations systématiques qui s’exercent quotidiennement envers le peuple palestinien.
Depuis 1967, les gouvernements israéliens ont ouvertement mené, directement participé et exercé un contrôle absolu sur la planification, la construction, le développement, la consolidation et l’incitation à la construction des colonies de peuplement, indique le rapport.
«Conformément à l’article 49 de la quatrième Convention de Genève, Israël doit cesser toute activité de peuplement dans les colonies et ce sans conditions préalables», dit Madame Christine Chanet, présidente de la mission d’établissement des faits (France).
Le rapport indique que les colonies de peuplement sont établies et développées pour le bénéfice exclusif des Israéliens juifs. Les colonies de peuplement sont maintenues et développées à travers un système de ségrégation total entre les colons israéliens et le reste de la population habitant dans les territoires palestiniens occupés. Ce système de ségrégation est soutenu et facilité par un contrôle militaire et de maintien de la sécurité stricts et ce au détriment des droits du peuple palestinien.
«Aujourd’hui nous appelons le gouvernement d’Israël à s’assurer que les responsabilités pour toutes les violations soient établies, à mettre fin à l’impunité et à assurer que justice soit rendue pour toutes les victimes», dit Madame Asma Jahangir, membre de la mission (Pakistanaise).
Le rapport indique qu’Israël commet de sérieuses violations de ses obligations au titre du droit à l’auto-détermination et du droit humanitaire. Le rapport conclut aussi que le Statut de Rome établit la juridiction de la Cour Pénale Internationale sur le transfert des populations dans les territoires palestiniens occupés.
«L’ampleur des violations liées aux politiques d’Israël sur la dépossession de terres, les évictions, les démolitions d’habitations et les expulsions de Palestiniens démontrent la nature généralisée de ces violations. La violence et l’intimidation à l’encontre des Palestiniens et de leurs biens est motivée par le désir de chasser les populations locales de leurs terres, permettant ainsi l’extension des colonies de peuplement», dit Madame Unity Dow, membre de la mission (Botswana).
Le rapport indique que les entités privées ont aussi permis, facilité et profité de la construction des colonies de peuplement, autant directement qu’indirectement.
