SUBJECT: NOTICE OF EXPORT OF HAZARDOUS WASTE, DGGIMAR. 710/000162
1. Post ESTH office received on behalf of EPA, a letter dated 14
January, 2010 from Secretaria de Medio Ambiente y Recursos
Naturales (SEMARNAT), concerning the exportation of hazardous waste
from the following United States companies to Mexico:
- Arcelor Mittal La Place, LLC.
2. The basic information in this letter from Alfonso Flores
Ramirez, Director General, division for the management of hazardous
waste is as follows:
In reference to your letter dated January 4, 2010, received in this
General Directorate on January 8, 2010, with document number
DGGIMAR.710/000162 and in reference to the Export of Hazardous
Waste Notification under number 01/2010, through which, the company
ARCELOR MITTAL LA PLACE, LLC, requests authorization for the export
of electric arc furnace dust to ZINC NACIONAL, S.A., during the
period of January 1 - December 31, 2010, using the customs in
Laredo, Texas and El Paso, Texas. I would like to inform you that
this Directorate has no objection to the transborder actions being
executed in accordance with the Export Notifications above
mentioned.
Nevertheless and according to Articles 50, 85, 86, 89, 90 and 91 of
the General Law of Prevention and Integral Negotiations of
Hazardous Waste (LGPGIR, initials in Spanish) and Articles 107,
108, 114, 115, 117 and 118 of the LGPGIR Regulation, for each of
the transborder actions, ZINC NACIONAL, S.A. will have to negotiate
before this Undersecretary's office the corresponding
Authorizations of imports. Likewise, the company will import as a
maximum 240,000 tons per year, which is its recycling capacity in
accordance with its Authorization No. 19-46-PSVI-04 (RENEWAL),
dated July 23, 2004.
