SUBJECT: GON appeals dismissal of Kaka case

1. On July 23, 2008 the investigating judge dismissed the criminal
case against jailed Nigerien journalist Moussa Kaka and ordered him
freed from prison. Nigerien law grants prosecutors 48 hours to
appeal such rulings, so Kaka was not immediately released.
2. On July 25, the state prosecutor appealed the decision and Kaka
will remain held pending resolution of the appeal.
3. No hearing date has been set for the appeal.
