1. (SBU) Summary: Post requests that nonimmigrant visa eligibility
be restored for Ivan Enrique Garcia Cortes. Post has confirmed that
Garcia Cortes satisfactorily resolved his property dispute with the
U.S. claimants Oscar and Sandra Dubon in December 2007. Please see
action request in Paragraph 3. End Summary.
2. (SBU) On October 18, 2006, U.S. citizens Mr. and Mrs. Oscar and
Sandra Dubon settled their property dispute with Ivan Enrique Garcia
Cortes by accepting indemnification bonds issued by the Government
of Nicaragua (GON) worth an estimated 935,600 cordobas ($52,486).
On November 1, 2006, the Embassy received a copy of the settlement
document from the GON. On December 3, 2007, The Dubon family
received the bonds. On June 23, 2008, Econoff spoke to Mrs. Sandra
Dubon who confirmed that her family's claim had been settled. Mrs.
Dubon lives in Northridge, California and may be contacted by
telephone at the following number: (818) 363-5458.
3. (SBU) Action Request: Post finds sufficient evidence that the
property dispute between Oscar and Sandra Dubon and Ivan Enrique
Garcia Cortes has been resolved. Thus, we request the Department
consider removing Garcia Cortes' visa ineligibility under Section
2225.
