High Court Judgment Finds in Favour of Wellington Regional Stadium Trust
Justice Gendall yesterday, in the High Court, ruled in favour of Wellington Regional Stadium Trust in the matter of a
dispute regarding access to a corporate box. An order for costs has also been made in favour of the Stadium Trust.
David Gray, Stadium Trust chief executive said: “The judgment recognises the Stadium’s right to ensure the safety and
enjoyment of all its patrons, and its ability to deliver that.”
The Judgment denied the application by the Shayne and Brendon Hodge to secure an injunction against a trespass notice
issued by the stadium.
“We have a policy of ensuring that all patrons have an enjoyable and safe stadium experience, across the entire
facility,” Mr Gray said.
“We welcome Justice Gendall’s decision as it endorses our right to enforce an acceptable standard of behaviour at what
is clearly a family venue, catering to people of all ages.
“The decision reinforces our policy in dealing with unacceptable behaviour. The vast majority of cases are successfully
defused by security staff talking to boisterous patrons and no further action is required.
“In this case, after two attempts by our staff to resolve the situation, the Police were called. While evicting the
first party, the Police determined they had reason to evict a second person.
“We sought an apology and a good behaviour undertaking from both parties and, had that been forthcoming, that would have
been the end of the matter. No apology was forthcoming and a trespass notice was subsequently issued,” Mr Gray said.
