Sports Drug Agency To Appeal Ruling

The New Zealand Sports Drug Agency has made a decision to appeal the recent District Court decision finding against one of its decisions, to the High Court.
Such an Appeal is provided for, under the relevant legislation, where the Agency believes that the decision is "erroneous in point of law".
The Agency was satisfied with the bulk of the District Court decision which gave approval to the procedures and forms used by the Agency in the test in question.
The Agency does not believe that the decisions of the Judge, with respect to the time delay in getting the samples to Sydney, or the compliance of the versapak containers with the regulations, reflected a correct application of the New Zealand Sports Drug Agency Act.
The versapak containers have been the international standard for many years and have been used at all major sporting events including Olympic Games. The drafting of the legislation was completed with instructions from the Agency to provide for these containers.
The Agency will do whatever it can to assist in bringing about a speedy hearing of the case.
