EDS joins Trans-Tasman Resources High Court appeal

“EDS has today filed a notice to join (in opposition) Trans-Tasman Resources (TTR) appeal against the decision to reject its marine consent application to mine ironsands in the South Taranaki Bight,” says EDS Executive Director Gary Taylor.

“At the hearing, EDS opposed TTR’s application due to inadequate information about the effects on the environment and the failure of the adaptive management proposal to meet criteria recently set by the Supreme Court.

“EDS supports the EPA’s decision. This will be an important test case as it will set binding law on how the EEZ Act is to be applied.

“EDS has a keen interest in seeing that the new Act sets high standards for activities in our Exclusive Economic Zone and Extended Continental Shelf.

“We will also be contending that some of the TTR appeal points cannot be considered by the High Court because they are not points of law.

“EDS will be represented by Robert Enright, Barrister, and Nicola de Wit.

“Regrettably environmental legal assistance funding is not available for proceedings under the EEZ Act, including the first instance hearing and this High Court appeal.

“So EDS is seeking assistance from its members and supporters to enable it to participate in the appeal,” Mr Taylor concluded.
