Minor Tidy Up Of Habeas Corpus Procedure
The Law Commission has recommended some minor technical changes to the procedural aspects of the law of habeas corpus.
The Law Commission’s report entitled Habeas Corpus:Refining the Procedure was tabled in Parliament today, 5 February 2008.
“The recommendations in this report are technical tweaks that will allow the law of habeas corpus to work better”, says President Sir Geoffrey Palmer.
“In its 1997 report the Commission recommended a simplified procedure for dealing with habeas corpus applications”.
“The reform has been successful. But like many laws, experience has revealed a few anomalies and the Commission’s recommendations tidy these up”.
The report, which can be viewed on the Commission’s website, is accompanied by a draft Bill that shows with precision the effects that it will have.
