Appeal Court Dismisses Water Protest

The Court of Appeal of New Zealand today dismissed an appeal by anti-water campaigner Jim Gladwin against a High Court decision that water and wastewater services were goods and services, under the Commerce Act.
The decision of the court was unequivocal and included an award of costs, which had not been sought.
Metrowater chief executive Graham Coxhead said he was pleased with the decision, which confirmed the basis for the company's charges and provided consumer protection through the Commerce Act.
He said the company would now be writing to a small number of customers who had expressed interest in the outcome of the case.
