No Appeals Against Winebox Decision – Time To Act

Published: Tue 21 Sep 1999 08:40 AM
The legal fight over the Winebox Report is over and Rt Hon Winston Peters is the winner.
No appeals have been lodged against the High Court Judges’ ruling last month that overturned the major parts of the Winebox Report, in favour of the New Zealand First Leader.
The Judges ruled that Sir Ronald Davison made an error in law in finding that the so called “Magnum” transactions were legal, and that there was no incompetence on the part of the Inland Revenue Department and the Serious Fraud Office.
Mr Peters was advised by his counsel Brian Henry this evening that no appeals against the judgment had been lodged by Sir Ronald Davison himself, Fay Richwhite, Inland Revenue, or the Serious Fraud Office.
“This proves that none of these parties had the confidence to take this issue any further and that they accept Sir Ronald Davison’s report was seriously flawed because of his incorrect interpretation of the tax laws. It represents a total victory for the taxpayers of New Zealand, and the Inland Revenue Department should stop dragging its feet over collecting the outstanding tax.
“We also suggest that it is time for the hands behind European Pacific, the vehicle for these sham tax transactions, to come forward and bare their souls to the Inland Revenue Department and the Serious Fraud Office,” said Mr Peters.
