ACT Leader Richard Prebble said today the Court of Appeal has agreed to consider why it is urgent that the court hears argument as to why the injunction granted to Mrs Awatere Huata be lifted.
"The ACT party lawyers will be in court at 10:00 am tomorrow to explain that if the injunction is lifted Mrs Huata could be out of parliament by 2:00 pm.
"I will be taking a recommendation to the ACT caucus that Mrs Huata's seat be declared vacant on the grounds that her actions have altered the proportionality of parliament. ACT was elected with 9 MPs and we now have 8 through her actions. The 145,000 people who voted ACT are entitled to have their representation in parliament restored," Mr Prebble said.
