FairWay to provide a building and construction dispute resolution service
Nationwide mediation and dispute resolution specialist, FairWay Resolution Limited has launched a building and
construction dispute resolution service.
FairWay’s new service will further extend its current provision of dispute resolution services between builders, other
contractors involved in building houses and home owners. The service is a quick and inexpensive alternative to going to
court.
There are a many reasons things might go wrong with a building project. For example, the homeowner might have
unrealistic expectations of the scope of the building work, there might be a lack of communication between contractor
and client, there may be shortages of specified products which results in delivery delays, or the workmanship may not be
up to standard.
FairWay has also recently been appointed by the Minister of Building and Housing as an Authorised Nominating Authority
under the Construction Contracts Act 2002 to appoint appropriately qualified, trained and impartial adjudicators to
determine construction disputes.
The launch of the Authorised Nominating Authority service has been timed to coincide with sweeping changes under the
Construction Contracts Amendment Act, which will affect all new building contracts and the adjudication process from 1
December 2015.
Chief Executive – Greg Pollock says that recent changes to the Building Act provide consumers with greater rights under
the new legislation and that is a good thing for consumers.
“FairWay has been working with the building industry to resolve emerging issues with consumers before they escalate into
costly and intractable disputes.
The growth of alternative dispute resolution, such as mediation and facilitation, reflects the worldwide trend towards
early intervention to avoid the time and expense involved in litigation, not to mention the stress and anxiety
associated with having a dispute or going to court.”
Pollock says FairWay is excited to be providing this service that will help individuals and businesses resolve their
dispute as early and as cost-effectively as possible.
