Proposed District Plan - Appeals Update June/July 2017
In April 2016 the Council's decisions on the Proposed District Plan were notified. 72 appeals and 410 Section 274 notices to those appeals were lodged with the Environment Court on the Council's decisions.
In its Second Case Management Memo the Court issued directions authorising negotiations between the Council and appellants. Since then TCDC staff have had over 60 without prejudice meetings with appellants and engaged in 47 court assisted mediation sessions. Through those processes the court has now issued decisions or consent orders settling 26 appeals in their entirety, with a number of other consent orders being issued to partially settle appeals.
Over the next month 2 Environment Court hearings are scheduled (amateur radio provisions and the mapping of Pauanui Airfield) and 2 further court assisted mediations have been scheduled (in relation to the Transportation and Mining topics). Various work continues on the other major topics (subdivision, landscape, coastal environment, etc.) in an effort to settle these by consent order rather than via formal court hearings.
