Resignation stands
According to legal advice received the resignation of Paraparaumu-Raumati Community Board member Dale Evans received on June 15 must stand, Chief Executive of Kapiti Coast District Council, Pat Dougherty, said today.
“The Council sought legal advice following Mr Evans’ attempt to rescind his letter of resignation last Friday (June 26). His original letter said his resignation would take effect from June 27.
“Our advice is that we are obliged to accept the resignation on the date it was received.
“Based on that advice, I have now informed Mr Evans that I am obliged to accept his original letter of resignation. The electoral officer has been formally notified and is now setting in train the actions required to initiate a by-election.”
A notice of a by-election will be published in this Thursday’s Observer.
Nominations will close no later than noon Friday
July31 and the election will be held on September 19, 2009.
The by-election will be held by postal vote under the Single
Transferable Voting (STV) electoral
system.
